ARTICLE 2- SUBJECT 

The subject of this contract is 4077 regarding the sale and delivery of the product, the qualifications and sales price of which are specified below, which the BUYER has ordered electronically from the SELLER's thermokit.com website.

ARTICLE 4- GENERAL PROVISIONS 

4.1- The BUYER declares on the thermokit.com website that he has read the preliminary information about the basic characteristics, sales price, payment method and delivery of the product subject to the contract and has given the necessary confirmation in electronic environment.

4.2- The product subject to the contract is delivered to the BUYER or the person/organization at the address indicated within the period specified in the preliminary information on the website, depending on the distance of the BUYER's residence for each product, provided that the legal 30-day period is not exceeded.

4.3- If the product subject to the contract is to be delivered to a person/organization other than the BUYER, the SELLER cannot be held responsible if the person/organization to be delivered does not accept the delivery.

4.4- The SELLER is responsible for the delivery of the contracted product in a sound, complete, in accordance with the qualifications specified in the order and with warranty documents and user manuals, if any.

4.5- For the delivery of the product subject to the contract, the signed copy of this contract must be delivered to the SELLER and the price must be paid in the form of payment preferred by the BUYER. If, for any reason, the product price is not paid or canceled in the bank records, the SELLER is deemed to be relieved of its obligation to deliver the product.

4.8- Defective or damaged products of the products sold or not with the warranty certificate can be sent to the SELLER for the necessary repair within the warranty conditions, in which case the shipping costs will be covered by the SELLER. 

4.9- This contract becomes valid after it is signed by the BUYER and sent to the SELLER by fax or mail.


Order:


The order is deemed to have been placed after the TL amount (total installment amounts in installment transactions) of the products added to the shopping cart, including VAT, is approved by the "BUYER".

If the bank or financial institution does not pay the product price to the SELLER due to the unfair or unlawful use of the credit card of the "BUYER" by unauthorized persons, not due to the fault of the "BUYER", after the delivery of the product, the "BUYER" will deliver it to him. If the goods/services are to be delivered to a person/organization other than the "BUYER", thermokit.com cannot be held responsible for additional delivery costs that may arise from the person/organization to be delivered not accepting the delivery, inaccuracy in the shipping information and/or not being at the address of the "BUYER".

Delivery time varies within 3 working days at the latest in Hatay after the "order dispatch notification mail" is sent, and 1-5 business days depending on the address specified by the "BUYER" outside Hatay.

In cases where the cargo or supplier company or the "site" consignor delivers once a week, and in cases where there are inaccuracies or deficiencies in the shipping information, unexpected situations such as some social events or natural disasters and force majeure situations, there may be a delay in the specified day time.

Warranty conditions:


thermokit.com is not under any warranty liability for the products sold. The warranty conditions of the purchased products are provided by the importer/manufacturer company, which is the supplier company. Get information on the subject through the warranty document / product manuals sent with the product or by calling the technical support hotline that comes with the product invoice.

ARTICLE 5- USE OF THE RIGHT OF WITHDRAWAL


The "BUYER" may exercise its right of withdrawal within 15 (fifteen) days from the delivery of the contractual goods/services to himself or to the person/organization at the address indicated. In order to exercise the right of withdrawal, thermokit.com customer services must be notified by fax, e-mail or telephones in the communication section within the same period. If this right is exercised, it is obligatory to return the original invoice for the delivered goods/services.

The product to be returned must be sent to the Logistics Center in the contact information or to the Logistics Center on the back of the invoice.

The "BUYER" can return it with the return form, together with the courier company that delivers to the address. In the return of defective or defective products, the shipping cost belongs to thermokit.com. The cargo return fee for defective and non-defective products belongs to the “BUYER”. If the original product and/or invoice is not sent, the price and other legal obligations cannot be returned to the "BUYER".

Thermokit.com returns the cost of goods/services to the “BUYER” within 3 days following the receipt of the original product and invoice, if the necessary conditions for the exercise of the right of withdrawal have been met. The reflection time of the refunds made to the credit card on the credit card accounts is at the discretion of the relevant bank.

If the product is defective, the return conditions are stated in the warranty conditions section.

ARTICLE 6- CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED 


The right of withdrawal cannot be exercised for goods that cannot be returned due to their nature, are likely to deteriorate rapidly and expire.


The products for which the right of withdrawal will be used must not be used or assembled. Returns of damaged or damaged, scratched, assembled or used products are not accepted.

ARTICLE 7- AUTHORIZED COURT 

In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts in the BUYER's or SELLER's settlement are authorized up to the value declared by the Ministry of Industry and Trade.


In the event that the order is realized, the BUYER is deemed to have accepted all the terms of this contract.
